ActBlue Demands Transparency in GOP-led Congressional Investigation

After fully cooperating with Congress for 18 months, ActBlue raises serious concerns about the legitimacy and legality of a now-partisan Congressional investigation.

ActBlue has publicly released a letter sent to three Republican-led Congressional committees currently investigating our organization: (1) the House Judiciary Committee, (2) the Committee on Oversight and Government Reform, and (3) the Committee on House Administration. This letter calls out a deeply concerning shift in the stated purpose of these investigations—one that raises constitutional red flags and threatens to obstruct millions of grassroots donors from participating freely in our democracy.

Over the last year and a half, ActBlue has cooperated fully with these committees’ partisan-driven inquiries. We’ve voluntarily provided detailed information, producing over 3,500 pages of documentation, and responded expediently in good faith to each request. Our organization always operates with transparency, robust compliance procedures, and a longstanding commitment to security, trust, and the law. This is a core value for ActBlue and it has never been contingent on political or legal scrutiny. We do so because we take our work very seriously as a platform that enables democracy and we are extraordinarily proud of our positive impact on one of the most cherished principles of our nation: free and fair elections. 

But recent public statements from committee chairs and the release of a grossly misleading interim report suggest this investigation has been co-opted. Rather than a legitimate exercise in legislative oversight, our worst fears have been confirmed – the investigation is being used to serve a separate agenda: fabricating a foundation for a politically motivated criminal probe ordered by the President of the United States.

The U.S. Constitution is very clear: Congress has the authority to investigate in support of its legislative functions. It does not have the authority to act as an investigative arm of the Executive Branch. That’s not just an opinion—it’s a fundamental principle of our Constitution, repeatedly upheld by the Supreme Court. The separation of powers is not optional. It is the very structure that protects all Americans from political retribution disguised as law enforcement.

It is increasingly difficult to construe the committees’ actions as anything but partisan. Despite public reporting of irregularities on the Republican-aligned WinRed platform—which far exceed any associated with ActBlue—the committees have refused to investigate it. The double standard is not only unfair; it chills political participation and violates the First Amendment rights of U.S. citizens.

We take the integrity of our platform seriously. ActBlue has industry-leading fraud prevention systems in place, including behavioral fraud detection, address and CVV verification, and rigorous screening for illegal foreign contributions. And we continue to strengthen these safeguards, because we believe in transparency, compliance, and public trust. What we will not accept is being singled out, smeared, or silenced for political reasons.

We call on the committees to explain their apparent coordination with the Department of Justice. If this investigation is now intended to support a criminal probe by the Executive Branch, which it appears to be, that must be called out for what it is — unconstitutional and un-American. While we intend to remain cooperative, it is imperative that the Congressional committees clarify their investigation.
